Terms of Service
The short version: BabyEats is a tracking aid for parents — not medical advice. Pro is a one-time purchase handled by Apple. Your data stays on your device and is yours.
1 · Agreement
These terms are an agreement between you and Pixeyo (contact: pixeyo@gmail.com) about the BabyEats iOS app. By installing or using the app you accept them. The app is distributed through the Apple App Store; Apple's standard Licensed Application End User License Agreement also applies, and where the two conflict for a consumer-protection matter, whichever gives you more protection wins.
2 · Not medical advice — the rule that outranks everything
BabyEats is a logging and tracking aid. It records the tastes and reactions you enter and applies a fixed counting rule — the 3-Day Rule — to your own entries. It is not a medical device, it does not examine your child, and it never diagnoses, treats, predicts, or prevents allergies, or replaces clinical judgment.
- The Untested · Day 1–3 · Safe · Reaction status reflects only your own entries. "Safe" means exactly one thing: you logged tastes on at least 3 distinct calendar days and did not log a reaction. The 3-Day Rule is a logging discipline, not a medical guarantee — it cannot rule out an allergy, and a forgotten log changes the status; the app cannot know what wasn't logged.
- What you observe in your baby, and your pediatrician's advice, always outrank the app — in both directions.
- The emergency gagging-vs-choking guide is general first-aid information based on published references (AAP / NHS) — not personalized instruction and not a substitute for certified infant first-aid training. If you believe your child is choking or having a serious reaction, call your local emergency number immediately — never wait for, or rely on, an app screen or notification. iOS may delay or suppress notifications (Focus modes, Low Power Mode, force-quit); no app can guarantee delivery.
3 · License and acceptable use
You get a personal, non-exclusive, non-transferable license to use BabyEats on Apple devices you own or control, for personal caregiving use, under the App Store rules. You may not reverse-engineer the app except where the law expressly permits it, resell it, or use its safety and first-aid copy out of context in ways that present it as diagnostic advice.
4 · BabyEats Pro (one-time purchase)
- Pro is an optional, one-time, non-consumable in-app purchase — not a subscription. US price $12.99; your local price is shown in the App Store. It supports Family Sharing, so one purchase covers both caregivers.
- Payment, receipts, restores, refunds, and Ask to Buy are handled entirely by Apple; refunds go through reportaproblem.apple.com.
- Pro unlocks convenience features only (unlimited custom foods, multiple baby profiles, Home and Lock-Screen widgets incl. one-tap logging, the Reaction Watch Live Activity, Insights, custom reminders, the PDF pediatrician report, themes & alternate icons). Safety features — the 3-Day Rule tracker, reaction logging, Big-9 allergen tracking, the emergency guide with one-tap call, and text/CSV/JSON export — are free and are never paywalled or delayed. If Pro is refunded or revoked, the app downgrades but never deletes or locks your data.
5 · Your data
Everything you log stays on your device — there is no account and no server (see the privacy policy; the App Store label is "Data Not Collected"). That also means you hold the only copy: you are responsible for backups (the free text/CSV/JSON export), and deleting the app deletes your log. Exports you share go only where you send them.
6 · Intellectual property
The app, its design, and its content are owned by Pixeyo and protected by law. The infant feeding and first-aid guidance sources cited in the app (such as AAP and NHS materials) belong to their respective institutions; the app cites them as published references and is not endorsed by or affiliated with them.
7 · Warranties and liability
The app is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim implied warranties and we are not liable for indirect, incidental, or consequential damages, or for outcomes arising from reliance on the app contrary to section 2. To the extent liability cannot be excluded, it is limited to the total amount you paid for the app (the one-time BabyEats Pro purchase price, if any).
Nothing in these terms limits liability that cannot lawfully be limited, or your mandatory statutory rights as a consumer (including under EU consumer law: conformity remedies, the 14-day withdrawal rules as applied by Apple's refund process, and your rights against the seller of record, Apple).
8 · Changes
We may update the app and these terms. Material changes to the terms will be reflected on this page with a revised effective date before they apply. The standing product commitments do not change: no accounts, no data collection, no diagnosis or allergy-prediction features, and the safety core — the 3-Day Rule, reaction logging, and the emergency guide — never paywalled.
9 · Governing law
These terms are governed by the laws of Romania, without prejudice to the mandatory consumer protections of the country where you live, which continue to apply in full.
